Terms of use

• By accessing or using The Gutsy Challenge website, you agree to be legally bound by these terms and conditions of use as they may be modified and posted on our website from time to time.
• We reserve the right to alter, suspend or discontinue any aspect of our website or the content or services available through it, including your access to it. Unless explicitly stated, any new and current features including new content, and/or the release of new interactive tools or downloadable resources shall be subject to these terms and conditions.
• Unless otherwise specified, the materials published on our website are presented solely for your private, personal and non-commercial use. In all other cases, permission must be sought from the GI CANCER Institute to use the materials. You assume total responsibility and risk for your use of our website and the use of all information contained within it. For more information, see the Disclaimer paragraph below.
• The Gutsy Challenge makes no representations whatsoever about any other websites that you may access through our website or which may link to our website. When you access any other website you understand that this is independent from The Gutsy Challenge and that we have no control over the content or availability of that website. In linking to any other website, The Gutsy Challenge does not endorse or accept any responsibility for the content, or the use of, such a website and shall not be liable for any loss or damage caused or alleged to be caused by or in conjunction with use of or reliance on any content, goods, or services available on or through any other website or resource. • We will try to make our website available and accessible but cannot guarantee that our website will operate continuously or without interruptions or be error-free and can accept no liability for its unavailability or malfunction. Competition

1. In the event of a dispute the decision of The GI CANCER Institute is final and no correspondence will be entered into.
2. For the purpose of competition in the Gutsy Challenge, donations below the stipulated first level are recognised with an e-certificate but are not deemed to have “completed” the program.
3. This Promotion is being conducted by the Gutsy Challenge held by The GI CANCER Institute (ACN 093 854 267).
4. Information on eligibility and prizes form part of these Terms and Conditions. Entry into the Promotion confirms acceptance of these Terms and Conditions.
5. The Promotion commences at 9.00AM (EST) on Wednesday 1st September 2010.
6. Eligibility in Gutsy Challenge competitions is restricted to Australian residents.  
7. Each entrant will be allocated one ticket for every ten dollars raised.  An entrant may then select one or more prizes up to the total value of the tickets collected and dependent on the ticket value of each prize.  Once a selection has been made and submitted this is deemed as one set of prizes.
8. The Promoter is not responsible or liable for any change in the value of the prize occurring between 1 June 2010 and the date the prize is claimed.
9. Prizes are not transferable, exchangeable or redeemable for cash. In the event that any prize is unavailable, the Promoter reserves the right to substitute a prize of equal or greater value or to pay cash.
10. Any taxes which may be payable by the winner as a consequence of a winner receiving the prize is the sole responsibility of the winner.
11. The Promoter makes no representation or warranty as to the quality, suitability, merchantability of any of the goods or services offered as prizes.
12. Successful entrants will be notified by email after submitting their prize request.
13. Prizes will be delivered to the successful entrants within 2 months of the entrant receiving their last sponsorship.
14. Prizes that can be selected are dependent on the level of funds raised by the entrant.
15. Incomplete entries are void.
16. All entries are the property of the Promoter.
17. The Promoter may at any time disqualify an entrant or refuse entry of an entrant if:
1. the entrant fails to comply with and/or these Terms and Conditions;
2. the entrant is engaged in practices which subvert or intend to subvert these Terms and Conditions;
3. The judges’ decision is final and no correspondence will be entered into.
18. The Promoter is not liable for, and the entrant releases and holds the Promoter, its officers, employees and agents from, any and all liability, loss or damage whatsoever which is suffered or sustained, to persons or property (including but not limited to indirect or consequential loss), arising from or in any way related to the Promotion, or using or participating in, the prize.
19. If for any reason the Promotion is not capable of being conducted as planned, including but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, human error, technical malfunction or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter reserves the right in its sole discretion to disqualify any person involved in the tampering of the entry process, and to cancel, terminate, modify or suspend the Promotion.
20. The Promoter is not liable or responsible for any error, omission, interruption, deletion, defect, delay in operation of transmission, communications line failure, theft, destruction, technical malfunctions, unauthorized access to, or alteration of, entries.
21. The Promoter is not liable or responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software or failure of any entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any website or any combination, including any injury or damage to any entrant’s or other person’s computer arising from or related to a entrant’s participation in the Promotion, or the downloading of materials in relation to this Promotion, or an entrant’s inability, difficulty or failure to access any electronic site in the Promotion.
22. The Promoter may at any time disqualify an entrant or refuse entry of an entrant if:
1. the entrant fails to comply with and/or these Terms and Conditions;
2. the entrant is engaged in practices which subvert or intend to subvert these Terms and Conditions;
3. the Promoter determines that an entrant is tampering with the entry process or the operation of the Promotion.
23. The Promoter and its related entities and GI CANCER Institute are collecting personal information for the purpose of conducting this Promotion and for direct marketing purposes. Personal information may be disclosed to supply partners and other persons involved in the conduct of the Promotion and/or direct marketing. If an entrant does not provide all personal information requested, the entrant will not be able to enter the Promotion. The entrant may access his or her personal information by contacting the Privacy Officer at the Promoter. All personal information is handled in accordance with the Promoter’s Privacy Policy.
